Draft — pending solicitor review. This is a plain-English draft. It isn't legal advice yet and isn't final until a solicitor has reviewed it.
These terms are a contract between your business and us. Please read them before you sign up. If something isn't clear, email hello@glossydata.com.
1. Who we are
Glossy Data is run by Glossy Data (entity details to be published). Company number and registered office: entity details to be published.
When we say "we", "us" or "our", we mean Glossy Data. When we say "you", we mean the business that signs up, and anyone using the service on its behalf.
You can reach us at hello@glossydata.com.
2. For businesses only
Glossy Data is sold to businesses, not consumers. By signing up you confirm that you are using it for your trade, business, craft or profession. Sole traders and freelancers are welcome when buying for their business.
These terms are for business purchases. Nothing in them limits rights or remedies that cannot legally be excluded.
If you sign up for an organisation, you confirm you have authority to accept these terms for it.
3. Accounts and plans
- Paid plans are billed monthly or yearly. Yearly plans cost 10% less than 12 monthly payments.
- There is no free trial. The free preview includes website checks, partial buyer questions and a short AI answer excerpt when available.
- Free previews are subject to usage limits. Full questions, answers, cited sources and ongoing tracking require a paid plan.
- A preview may reuse an earlier check, with its collection date shown. Email verification creates an account; it does not unlock paid insights. We may change or end free previews at any time.
- You're responsible for keeping your sign-in details safe and for activity in your account. Tell us straight away if you think someone else has access.
- Please give us accurate business and billing details and keep them up to date.
4. Credits
Each plan includes a monthly allowance of credits. Checking a question in an AI engine uses credits. Different engines and actions use different amounts, as shown on our pricing page.
- Your monthly allowance resets at the start of each billing month. Unused credits don't roll over.
- Top-up credits you buy separately last 12 months from purchase. We use your monthly allowance first.
- When you run out, tracking pauses until your allowance resets. It doesn't carry on and charge you more, unless you've turned on top-ups or overage yourself.
- In your first paid month, 40% of your credits are available straight away and the rest build up day by day over 30 days from your first payment. From your second month, your full allowance is available on each billing date.
- Credits have no cash value. They can't be refunded, sold or transferred, except as part of a refund under section 6.
We may change how many credits an engine or action uses, for example when a provider changes its prices. We'll show the current weights in the app and give you notice of any increase.
5. Prices and VAT
Prices are in the currency shown on our pricing page and at checkout (US dollars, euros or pounds sterling). Your account is billed in the currency of your first payment.
We're not VAT-registered, so no VAT is charged. If we register we'll give 30 days' notice before adding VAT.
Prices are exclusive of any VAT that may become payable. If you're a business outside the UK, you may need to account for tax locally under the reverse-charge rules.
We take payment in advance for each billing period by card through Stripe. If a payment fails we'll tell you and try again. If it still fails, we may pause your account until it's paid.
6. Payments and refunds
Payments cover the billing period selected at checkout. We do not offer a voluntary money-back guarantee.
Cancelling renewal does not itself refund a payment already made. Any statutory rights and refunds expressly provided elsewhere in these terms remain unaffected.
7. Cancelling
You can cancel your subscription renewal at any time from Billing in your account. Once cancelled, your subscription will not renew. Your access continues until the end of the period you have paid for.
This applies to monthly and annual plans. Renewal stays off unless you choose to turn it back on. Cancelling renewal does not cancel charges already incurred.
8. Changes to prices
We may change our prices. We'll give you at least 30 days' notice by email before a new price applies to you.
The new price starts from your next renewal after the notice period. If you don't want to pay it, you can cancel before then.
Founding offers that say "price locked for life" keep their price for as long as the subscription stays active.
9. Using the service properly
You must follow our acceptable use policy. In short: use audits fairly, don't try to get round our limits, and don't scrape or resell our data.
We may suspend or close accounts that break it. See section 15.
10. What AI answers are, and what they aren't
Glossy Data reports what third-party AI engines said, at a particular time and place, when asked a particular question.
- AI answers vary from one run to the next, even for the same question. A single answer is not a fact about your business.
- Our scores are statistical estimates. We show them with ranges and the number of answers behind them. They can be wrong, especially when based on few answers.
- We don't control any AI engine, and we can't make one recommend you. We don't guarantee any result, ranking or recommendation.
- AI answers can contain mistakes about you or other businesses. We show them as they were given. They are not our statements.
- Our suggested fixes are general guidance, not professional advice. You decide what to change.
Glossy Data is independent. We are not affiliated with, endorsed by or partnered with OpenAI, Google, Anthropic, Perplexity or Microsoft. Their names are used only to describe the engines we check.
11. Your data and our intellectual property
Your data stays yours. That includes your business details, the questions you track and the reports you create. You give us permission to use it to run the service for you.
We may use answer data in aggregated, anonymised form to improve the service and to publish industry statistics. These never identify you as a customer. Our privacy notice explains how we handle personal data.
Glossy Data, our software, scoring methods, designs and content belong to us or our licensors. You may use reports we produce for your own business, and share them with your team, clients and advisers.
If you send us feedback or ideas, we may use them without owing you anything.
12. Agencies and white-label reports
- If you use an agency plan to track businesses for clients, you're responsible for having your clients' permission to do so.
- You're responsible for what you tell your clients about our results, including in white-labelled reports. Please don't present estimates as guarantees.
- Credits are pooled across your client workspaces. Prospect audits (60 credits each) come from your pooled credits.
- Where you give us your clients' personal data, our data processing agreement applies.
- Your clients have no contract with us. You're responsible for your own contracts with them.
13. Availability and changes to the service
We work hard to keep the service running, but we don't promise it will always be available or error-free. We may need to pause it for maintenance or for reasons outside our control.
AI engines and data providers change often. We may add, change or remove engines and features. If we remove something important that you pay for, we'll tell you and you can cancel.
14. Our liability to you
Nothing in these terms limits or excludes liability that can't be limited or excluded under English law. That includes liability for death or personal injury caused by negligence, and for fraud.
Subject to that:
- We aren't liable for loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss.
- We aren't liable for what third-party AI engines say, or for decisions you make based on their answers or our scores.
- Our total liability to you, for everything arising from these terms, is limited to the fees you paid us in the 12 months before the claim.
15. Suspension and ending these terms
You can end these terms at any time by cancelling and closing your account.
We may suspend or close your account, with notice where reasonable, if you seriously or repeatedly break these terms, don't pay, or use the service in a way that could harm us, other users or third parties.
We may also end the service for everyone with at least 30 days' notice. If we do, we'll refund any prepaid fees for the period after it ends.
Before your account closes, you can ask us for a copy of your data. We then delete it as set out in our privacy notice.
16. Changes to these terms
We may update these terms. For changes that matter, we'll email you at least 30 days before they take effect. If you keep using the service after that, the new terms apply. If you don't agree, you can cancel before they start.
Small changes, such as fixing typos or clarifying wording, may take effect straight away.
17. Law and courts
These terms are governed by the law of England and Wales.
The courts of England and Wales have exclusive jurisdiction over any dispute. Before going to court, please send us a written complaint by email to hello@glossydata.com. We reply in writing, usually within one working day, and will try to resolve it.
If any part of these terms can't be enforced, the rest still applies. These terms, together with the acceptable use policy and, where it applies, the data processing agreement, are the whole agreement between us.
